California judge investigated for zapping prisoner

SAN FRANCISCO (Reuters) - A California judge who ordered a prisoner zapped with 50,000 volts of electricity for talking too much in court has come under official investigation by the state's judicial authorities. The Commission on Judicial Performance announced Wednesday that Judge Joan Comparet-Cassani of the Long Beach Municipal Court was being investigated for the June 30, 1998, incident in which she ordered a bailiff to activate the electronic security belt worn by Ronald Hawkins.

``The commencement of the commission's investigation is not a determination of judicial misconduct,'' the commission said in a brief statement. Hawkins was convicted of stealing a bottle of aspirin from a drug store, a misdemeanor offense. Because he had two prior felony convictions prosecutors were seeking a much longer sentence for him under California's ``three strikes'' law. Hawkins in July sued Comparet-Cassani, claiming $50 million in damages - $1,000 for each volt he endured while defending himself at a sentencing hearing.

The lawsuit, filed on Hawkins' behalf by Los Angeles attorney Stephen Yagman, alleged Comparet-Cassani subjected him to torture in violation of the U.S. Constitution's ban on the use of unreasonable force, cruel and unusual punishment and punishment before a prisoner is convicted and sentenced. Comparet-Cassani has previously said that a code of judicial ethics prevented her from discussing Hawkins' criminal case while it was pending.

Hawkins' lawsuit also named the Los Angeles County Sheriff's Dept. as a co-defendant and sought an injunction barring use of the security devices, known as REACT belts, on defendants who do not present a physical threat.

The 50,000-volt electric shock, lasting eight seconds, was administered after Comparet-Cassani repeatedly warned Hawkins to stop interrupting her. People in the courtroom said Hawkins grimaced and stiffened as the electricity surged through his body. It was believed to be the first activation ever in Los Angeles of a prisoner's electronic security belt.

In recent years, members of Congress have gone to jail for child molestation, fraud and other charges.

Our research found 117 members of the House and Senate who have run at least two businesses each that went bankrupt, often leaving business partners and creditors holding the bag. Seventy-one of them have credit reports so bad they can't get an American Express card (but as members of Congress, they get a government-issued Amex card without a credit check).

Fifty-three have personal and financial problems so serious they would be denied security clearances by the Department of Defense or the Department of Energy if they had to apply through normal channels (but, again, as members of Congress they get such clearances simply because they fooled enough people to get elected).

Twenty-nine members of Congress have been accused of spousal abuse in either criminal or civil proceedings. Twenty-seven have driving while intoxicated arrests on their driving records. Twenty-one are current defendants in various lawsuits, ranging from bad debts, disputes with business partners or other civil matters.

Nineteen members of Congress have been accused of writing bad checks, even after the scandal several years ago, which resulted in closure of the informal House bank that routinely allowed members to overdraw their accounts without penalty. Fourteen members of Congress have drug-related arrests in their background, eight were arrested for shoplifting, seven for fraud, four for theft, three for assault and one for criminal trespass.

Island Officials May Try to Block Militia on Saturday Emergency Strategy Meeting by Township Held

Echoes from Ruby Ridge and Waco heard

Bois Blanc Island, MI (August 12) - An emergency meeting of the Bois Blanc Township board was called today to plan a strategy to deal with the Northern Michigan Regional Militia. Graham Whipple, Sheriff of Bois Blanc Island attended. What started as a show of support to a beleagured family may be taking on a more ominous and frightening spectre. The militia is determined to stand with Michael and Christine Stitt and their six children in opposition to a Township Board and the County that is waging a war of persecution against them. On Saturday, August 14, the militia will attempt to assemble on the Stitt's property. Last week, the commander, Norman Olson and chief of staff, Ray Southwell went to the island to measure the severity of the problem and the potential for confrontation. Olson said in a press release Thursday, "I can tell you that this situation is becoming frightenly like Waco and Ruby Ridge. We have a family being driven into the ground by a vindictive and hateful government body. The family is determined to stand their ground. They have no choice, no where to go, no one to help. The court and deceitful lawyers have forced this family into a corner. If they comply and dispose of all their animals and garden, they place their children at great risk. If they refuse to comply they will be arrested and jailed for contempt and possibly lose their children. They've asked me for help. I can't say no. The battlelines are forming and escalation may result in another armed standoff...this time with well trained militia defending a helpless family. I'm deeply troubled that this little matter might turn into another Waco or Ruby ridge. It starts like that, you know, and before we can stop it, it takes on its own energy. In the aftermath, we analyze where the mistakes were made and we vow to prevent it from happening again. Well, it is happening and I'm trying to stop it."The problem has a simple solution, but the township board refuses to negotiate with Olson who offered to withdraw the militia if a 1-year variance or waver is granted to the Stitts to keep their animals and buildings and garden on their 37-acre property on Bois Blanc Island near Mackinaw. "Is it too much to ask that a frightened family be given one year to ride out Y2K? Is it too much to ask that the children be told they can stay and that mom and dad are not criminals? Is a township board so insensitive that it cannot understand that people are frightened about Y2K and the animals and garden are the means of preparation to survive?"

On Saturday, the militia will go to Bois Blanc Island. No one knows what to expect between now and October 7, the deadline imposed by the District Court of Mackinaw County. Olson said late Thursday night, "I pray that Waco and Ruby Ridge are far behind us, but I fear that cold unfeeling and corrupted government bureaucrats are everywhere. First it was Idaho, then Texas. Let the record show that I have tried to offer a fair and rational solution. Failing that, the next American nightmare may come to Michigan.

Yugoslavia War info, finally being reported. The New York Times states: "NATO dropped hundreds of thousands of cluster bomblets all over Kosovo and these devices place the returning civilian population - the people we "saved" - in significant jeopardy.

One Times revelation: The normal unexploded rate of 10% has been "upgraded" to 30% because all of the unexploded bomblets found to date are marked with warranties that expire February '98. Yes, it appears the bombs were dropped in such reckless volume to get rid of obsolete

inventory. They are also appearing in Adriatic fishing nets, so much so the local fishing fleet was ordered to dock for the summer by the Italian government.

"U.S. warplanes dropped 1,100 cluster bombs during Operation Allied Force against Yugoslavia. Each contained 202 bomblets. That's 222,200 bomblets each. With a dud rate of 5 percent, it is likely that about 11,110 bomblets are sitting around unexploded." - Washington Post, August 4, 1999"

The "dud rate," as they so delicately put it, is six times higher than what they reported. Bringing the total to 66,660 bomblets out there waiting to explode.

The accident rate from these devices, along

with landmines, has been running at 10 per 100,000 residents per MONTH, about the same as the worst years of Afghanistan and Cambodia.

Before the NATO bombing, the KLA, a "terrorist organization" according to the US State Department (1998) and funded by criminal enterprises including the heroin trade and extortion according to Interpol, had been waging a guerilla terror campaign in Kosovo targeting primarily civilians, including uncooperative Albanians. By all reports, Yugoslavian forces are withdrawing according to schedule, but guess who's moving into the vacuum created by their departure? [KLA]
